Terms and Conditions

These Terms and Conditions govern the sale of shipping containers and related services by L & N Johnson Pty Ltd (ABN 20 001 318 065) (“L & N Johnson”, “we”, “our”, “us”) through lnjohnsoncontainers.com.au. By placing an order or using our website, you agree to be bound by these Terms.

1. Products and Descriptions

We sell new (one-trip) and used shipping containers in various grades, including Cargo Worthy and Repainted units. Used containers have been in international maritime transit and may show signs of wear such as surface rust, scratches, dents or weld repairs consistent with their grade. Photos and descriptions on our website are representative; the exact unit supplied may vary slightly in cosmetic appearance.

2. Quotes, Pricing and Payment

All prices are in Australian Dollars (AUD) and, unless stated otherwise, exclude delivery. Prices may change without notice until an order is confirmed in writing. We currently accept payment by direct bank transfer. Once you place an order, we will contact you to confirm final pricing, delivery details and our bank account information for payment. Your order will not be dispatched until cleared funds have been received in full, unless otherwise agreed in writing.

3. Delivery

Delivery is arranged by L & N Johnson or our transport partners to the address you provide. You are responsible for ensuring safe and adequate access for a heavy vehicle and crane/hiab truck at the delivery site. Estimated delivery timeframes are provided in good faith but are not guaranteed. Full details of our delivery process are set out in our Shipping and Refund Policy.

4. Risk and Ownership

Risk in the container passes to you upon delivery to the agreed site. Ownership of the container passes to you only once we have received payment in full.

5. Cancellations, Returns and Refunds

Because containers are sourced and delivered on a per-order basis, cancellations, returns and refunds are handled in accordance with our Shipping and Refund Policy, which forms part of these Terms. Nothing in these Terms limits any rights you have under the Australian Consumer Law.

6. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

7. Limitation of Liability

To the maximum extent permitted by law, and subject to the Australian Consumer Law, L & N Johnson’s liability for any claim arising from the sale of goods or services is limited, at our option, to the replacement, repair, or resupply of the goods, or the cost of doing so.

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
